Background

A "Best Practices Group" for CERCLA benchmarking studies was formed in 2004. As the Group developed, it has become a forum to discuss impediments and approaches to more cost-effectively manage multi-party sites, while strictly adhering to anti-trust guidelines. The Group managed, and held a CERCLA Sites Training Session for Internal Project Managers (PMs) in Houston last September, that was attended by ~65 PMs. Today, the Group provides a forum to share ideas, experiences and current practices regarding site management and to create a mechanism for member companies to gain perspective and strategic insights on the management practices of their peers.

Currently the Best Practices Group is sponsoring a 1-day training session that would be facilitated by PNL. The Session will showcase experts in the sediments assessment and remediation industry as discussion leaders.

Objectives

The Session would provide internal Project Managers with practical information on how to determine the 'best' course of action at contaminated sediments sites. The course will focus on strategies, issues and limitations associated with these risk and remedial alternatives and will discuss case studies. Additional topics will potentially include: trends in the sediments management industry, site allocation approaches, how to manage problematic sites, identification of natural attenuation, capping, and dredging alternatives, how to define your project end point and success, and how different management approaches and technologies are accepted by US EPA and the regulatory arena.

Speakers

Steven M. Jawetz is a Principal in the Washington, D.C. office of Beveridge & Diamond, P.C. His practice focuses on matters under the Comprehensive Environmental Response, Compensation, and Liability Act (Superfund), the Resource Conservation and Recovery Act (RCRA), and similar state statutes concerning industrial facilities and hazardous substance sites. Over the past two decades, he has helped clients deal with all aspects of their potential liabilities under these laws. He has also assisted corporations and developers with their transaction-related environmental liability issues.

Mr. Jawetz represents clients at a number of nationally significant contaminated sediment sites in rivers, lakes, and estuaries across the country. Several of these actions involve natural resource damages (NRD) claims by federal and state natural resource trustees. These sites typically require comprehensive strategies that address both remediation and NRD issues.

Mr. Jawetz also represents individual parties and acts as common counsel to groups of potentially responsible parties at Superfund and RCRA corrective action sites involving soil and groundwater contamination. His work focuses on helping clients respond to government demands; develop appropriate, cost-effective strategies for site investigation and cleanup; address potential cost recovery and natural resource damages claims; and obtain the best possible results through negotiation or litigation with the relevant agencies. Mr. Jawetz is chair of the Superfund Section in the firm's Environmental Practice Group.

Dr. Keith has directed and participated in numerous projects involved in shoreline redevelopment, remediation of sites environmentally impacted by contaminated surface water, groundwater, soils, sediments, and other geologic materials, and in addressing problems associated with nonpoint source pollution in stormwater runoff. He has conducted hydrogeologic and geochemical investigations at local and regional scales, geochemical evaluations of contaminated sediments, soils, industrial wastes, and mining wastes. He has participated in remedial investigations and feasibility studies at RCRA/CERCLA sites, preparation of Environmental Impact Statements/ Environmental Assessments as required by NEPA, and in the design of reclamation and closure plans for mine and other industrial sites.

Dr. Keith has a wide range of experience in leading the development of conceptual site models as they relate to ecological and human health risk evaluations and risk management strategies at sites with contaminated sediments. He has particular expertise in evaluating the geochemical characteristics of metals, including mercury in aqueous environments, and has developed and implemented detailed field investigations to determine the solid and liquid phase speciation of mercury to support fate and transport analyses in groundwater and sediment/soil systems using combined hydrogeologic and geochemical modeling approaches. Mr. Schadt, a senior aquatic scientist at Anchor Environmental, has over 28 years experience in environmental consulting, including nationwide experience with sediment remediation. Mr. Schadt's major area of focus is sediment cleanup projects, investigating water and sediment quality and biological affects, and developing strategies for sediment remediation and habitat restoration. His sediment project experience includes CERCLA, RCRA, state-led and voluntary action sites. Much of his project management experience is with sediment management issues, sediment characterization, cleanup strategy development, feasibility study development, long-term monitoring, and Natural Resource Damage Assessments. Mr. Schadt has participated in sediment cleanup projects in both freshwater and marine environments, including rivers, lakes, estuaries, bayous and bays.

Mr. Schadt has worked on a wide range of sediment sites. Physical environments have varied from freshwater creeks, rivers and lakes to marine estuaries and large bays. Constituents have included metals such as mercury, copper, arsenic, lead, zinc; and a range of organics including PCBs, PAHs, and dioxin. A number of the sites Mr. Schadt has managed include multiple PRPs and joint defense agreements amongst those parties. Mr. Schadt has worked on sites that are state lead under a variety of state programs, and he has also worked extensively under CERCLA and RCRA authority on sediment cleanups. Consistent with Anchor's services on sediment sites, Mr. Schadt has managed projects focused on site characterization and risk assessment; and has also worked on sites where remedial design, remedy implementation, and construction oversight have been the focus.

Mr. Hicks has over 25 years of experience on marine construction, dredging and environmental remediation projects throughout the United States. As Project Manager/Director, Mr. Hicks has assisted Superfund PRPs and PRP Groups, Paper Companies, Steel Manufacturers, Utility Corporations, US Army Corp of Engineers, and Municipalities in developing and implementing a variety of innovative solutions to contaminated sediment challenges. His strengths include project design and implementation, value-added engineering, constructability reviews and increasing production rates through efficient equipment/personnel utilization. In his current capacity for CH2M HILL, Mr. Hicks is charged with leading delivery of value-creating services for our clients with challenges related to sediments and sediment management, both nationally and internationally.

As the former National Practice Leader for Contaminated Sediments Programs under Shaw Environmental, Mr. Hicks provided leadership, direction and project design input to a team of professionals providing contaminated sediment management services throughout the United States. These services included: site investigations and assessments; permitting; remedial design; sampling, analysis and interpretation; pollution prevention and waste minimization; regulatory compliance support; environmental information management (GIS and database); remedial action implementation and construction services; long term monitoring; and final closure documentation.

Dr. Hall has more than 28 years of professional experience most recently focusing his efforts on ecological risk assessment, natural resource damages issues and restoration ecology through utilization of risk-based approaches in the petroleum industry. He is also active as a facilitator for environmental, social and health impact assessments (ESHIA) for capital projects in Chevron's Global Upstream and Downstream business units. His current business focus is as a subject matter expert for natural lands management to the Refining Business Unit and the Superfund & Specialty Portfolio Business Unit within Chevron's Environmental Management Company. He has also provided technical support and consultation for environmental applications of remote sensing technology while managing employees responsible for acquisition, processing, and interpretation of multi- and hyperspectral remote sensing data.

Prior to joining Texaco in 1989 Dr. Hall was employed at the U.S. Army Engineer Waterways Experiment Station, Ecosystem Research & Simulation Division in Vicksburg, MS as a research plant ecologist and as a technician at the Gulf Coast Research Laboratory in Ocean springs, MS.

Mr. Patmont has more than 28 years of experience in remedial investigations (RIs)/feasibility studies (FSs), risk assessment, source evaluations, contaminant transport modeling, and design of hazardous substance remediation and habitat restoration projects in aquatic environments-particularly lakes, large rivers, and estuaries. He has extensive sediment cleanup project experience in both Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) and state-led cleanups, and he is a recognized national expert in areas including source control and groundwater/surface water interactions, sediment risk characterization, sediment cleanup design, and integrated cleanup and habitat restoration design.

Mr. Patmont has authored and co-authored numerous peer-reviewed scientific/engineering journal articles on sediment cleanup and lake/river restoration, including several papers developed by the joint U.S. Environmental Protection Agency (EPA)/industry/ academia Remediation Technologies Development Forum. Mr. Patmont has directed more than 60 peer-, agency-, and stakeholder-reviewed RIs, risk assessments, FSs, remedial designs, wasteload allocations, and engineering reports for projects throughout the United States. In 2005, Mr. Patmont was selected as one of three national peer reviewers of EPA's Draft Sediment Remediation Guidance. His particular expertise in a wide variety of sediment and water quality assessments, and in presenting and evaluating the balance between risk reduction and cost of alternative cleanup remedies
(the "practicability" evaluation), has been instrumental in the success of these efforts.

Mr. Low is an attorney and engineer and concentrates his practice on alternative dispute resolution, settlement counseling and energy and environmental strategy consulting. Mr. Low was recently named as Director of the Energy and Environmental Programs Division of Project Performance Corporation in McLean, Virginia.

Mr. Low has served as an arbitrator, mediator and policy advisor in dozens of environmental cases and numerous environmental policy settings, including acid rain legislation, high level nuclear waste repository siting, asbestos in public and commercial buildings, waste capacity assurance, solid waste legislation, toxics release inventory reporting, used oil listing and management standards, energy efficiency and product design for disposal. He has served as a neutral allocator, settlement counselor or expert allocation witness in over 50 Superfund cases. He specializes in cases involving sediment, area-wide watershed or groundwater contamination problems and multiple facilities. He successfully conducted a two-year arbitration process leading to a settlement involving allocation among 20 manufacturing plants for sediment contamination in the Fields Brook watershed in Ohio. He also was successful in developing an allocation among owners and operators of over 70 facilities for sediment contamination in the Hylebos Waterway leading into Commencement Bay. His allocation report in the Hylebos Waterway was accepted by EPA as a basis for cash-outs totaling over 10 million dollars, and also was the basis for settlements among performing parties. Other sediment contamination cases on which he has worked include Utica Harbor, Fox River and Green Bay.

From 1986 – May, 2003, Mr. Low served as president of TLI Systems, Inc., a subsidiary of TechLaw, and from 2003 to this year as president of TechLaw.   Mr. Low formerly served as branch chief and lead litigation attorney in EPA's Office of Enforcement from 1973-1979, Director of Policy for the National Commission on Air Quality from 1979-1981, and founding partner of the law firm of Shutler and Low in 1981.  He has argued cases before U.S. district and appellate courts.

Dr. Ziegler's primary expertise is in the area of contaminant fate and transport with an emphasis on the analysis of cohesive and non cohesive sediment transport.  He has developed state of the science sediment transport models (SEDZL, SEDZLJ) which are of importance in the study of waterborne pollutants in lakes, rivers, estuaries, and coastal waters.  Dr. Ziegler is a nationally recognized expert in the area of sediment stability and was an organizer of the Sediment Stability Workshop held in New Orleans in January 2002.

As the result of managing over 30 studies at contaminated sediment sites, Dr. Ziegler has acquired extensive experience in this area. Sites that he has worked on include: Upper Hudson River, NY (PCBs); Housatonic River, MA (PCBs); Lavaca/Matagorda Bay, TX (mercury); Lower Duwamish Waterway, WA (PCBs); Patrick Bayou, TX (mercury, PCBs, PAHs); Kalamazoo River, MI (PCBs); Lower Fox River, WI (PCBs); and Woonsaquatucket River, RI (dioxin). He has developed, calibrated and applied hydrodynamic, sediment transport, and contaminant fate and transport models to aquatic systems ranging from small streams to large rivers and impoundments to estuaries. In addition to expertise in computer modeling, Dr. Ziegler also has significant expertise in data analyses related to sediment transport/stability and contaminant fate and transport. He has developed unique approaches to integrating data and modeling analyses so that insights about critical fate and transport processes at a site can be developed. Associated with the modeling work, Dr. Ziegler has also designed and conducted field studies to meet the requirements of the modeling efforts.

Dr. Ziegler has published 18 articles in peer-reviewed journals and books. He has a Professional Engineer license from the state of New Jersey. In addition, Dr. Ziegler has served as an expert witness for the U.S. Department of Justice and an industrial client.

Mr. Quadrini has over 15 years of experience pertaining to the assessment and management of contaminated sediments in natural systems. He has participated in numerous studies that have covered a wide array of contaminants and environmental settings, some of which include: Grasse River, NY (PCBs); Newtown Creek, NY (PCBs, PAHs, metals); Upper Hudson River, NY (PCBs); Peconic River , NY (mercury); Lower Fox River, WI (PCBs); Kalamazoo River, MI (PCBs); and Southern California Bight, CA (PCBs, DDT). He has designed field sampling programs aimed at understanding contaminant sources, spatial and temporal trends in contaminant levels, fate and transport processes, and relationships between contaminant sources and receptors. He has also managed the development of hydrodynamic, sediment transport, chemical fate and bioaccumulation models for these sites, as well as the application of these models to assess the efficacy of various remedial strategies aimed at reducing risk to human and ecological receptors at these sites.

His recent work has focused on the design and evaluation of remedial strategies for contaminated sediment sites, including sediment removal, subaqueous capping, and in-situ treatment (via application of activated carbon to river sediments). As part of this effort, Mr. Quadrini has worked with national experts to develop and implement numerous field and desktop studies aimed at understanding the nature and extent of ice jams in a riverine environment, and their impacts on the selection of remedial strategies for managing contaminated sediments subject to these ice jams.

Mr. Quadrini is an active member of several professional societies, and has developed and presented numerous technical papers at scientific conferences. He is a registered Professional Engineer in the State of New Jersey, and is certified as a Diplomate of Environmental Engineering by the American Academy of Environmental Engineers.
